PLEASE NOTE that our PRIVACY POLICY has changed effective May 25, 2018.

Welcome to the Oneida Ltd. websites, which include but are not limited to the Oneida’s retail (oneida.com) and the foodservice (foodservice.oneida.com) websites as well as all content, features, functionality, and services offered on or thorough the same (individually and collectively, the “Websites”).

This website is owned and operated by Oneida, Ltd. (“Oneida”, “we”, “us”).  This Privacy Policy governs our data collection and use practices for Oneida.com, Anchorhocking.com, plateenvy.com, Anchorhockingbottles.com, theoneidagroup.com and foodservice.oneida.com (collectively referred to herein as ‘Oneida.com’). We appreciate the trust you have placed in us. Your privacy and security are our top priorities. This Privacy Policy explains what information we collect and how we use it, and under what circumstances we may disclose the information to third parties.  This Policy applies to all visitors to our websites, and all who purchase our products and services available through our websites (“Services”). By visiting our site, you agree to the terms of this Policy. 

You acknowledge that Oneida will use your information in the United States, and any other country where we operate.  Please be aware that the privacy laws and standards in certain countries, including your rights concerning your data and the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside.  We will transfer personal information only to those countries to which we are permitted by law to transfer personal information, and we will take steps to ensure that your personal information continues to enjoy appropriate protections.  Please read on to learn more about how we protect personal information that’s transferred outside of Europe.  IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, IMMEDIATELY STOP ACCESSING OUR WEBSITE.

Collection of personally identifying information.

When you create an account with us or place an order through our websites for yourself, for your company, or for others, all personally identifying information you provide (such as name, email address, postal/residence address, shipping address, and credit card or payment account number (where requested) is submitted via secured connection, and stored in a controlled, limited access environment.  The information that we collect in this manner is required to fill your order or request for price quote. We may also collect information about our communications with you.

Collection of other information.

Oneida may also ask for non-personally identifiable information from you in site surveys to assist in market research, product development and site design.  This information is voluntarily provided by you and is analyzed in aggregate to determine consumer trends and to obtain feedback on the functionality and appeal of our site. 

Cookie files and Web beacons.

Oneida.com uses files called cookies to track user sessions on our site.  A cookie is a small file placed on your computer from a web server containing a unique ID for your computer.  Cookies enable us to customize your shopping experience and provide you with relevant content and offers.  The cookie file does not contain any personally identifying information, and cannot control or access your computer or files located on your computer.  We may use “session cookies” (cookies that last until you close your browser) or “persistent cookies” (cookies that last until you or your browser delete them).  Examples of the information we collect and analyze from cookies include your activity on our site, including the URL you come from and go to next (whether this URL is on our site or not).

Oneida may also use Web beacons, sometimes called a “clear GIF”, which may be linked to cookies. Oneida may use technologies such as cookies to provide you with enhanced online display advertising tailored to your interests. 

How we use information we collect.

With your consentBy submitting inquiries or requests, or by purchasing our products and services, you consent to our use of your personally identifiable information to respond to your inquiries or requests, or to conduct payment transactions or process orders, and you consent to our sharing your personally identifiable information with our partners and affiliates as necessary to complete your payment transaction and/or to process your order. We may also send to your address catalogs and other mailings regarding new products and services.  If you do not wish to receive these mailings, please let us know by calling us at the correct number below. 

With Third Party Providers.  We may establish a relationship with certain companies that perform shipping and delivery, consumer networking, marketing, and other services and promotions for site visitors and customers. We may employ third parties to process personal information on our behalf as necessary for the installation and testing of new software or for security testing of our systems, based on our instructions and in compliance with this Privacy Policy.These companies have access to your personal information as needed to perform their functions, and are contractually obligated to maintain the confidentiality and security of the data.  They are restricted from using this data for other purposes, and may not alter or resell the data. Under no circumstances will we rent or sell your personally identifiable information.

We do not knowingly collect – either passively or actively – any information about children under thirteen years old.  Anyone using our site represents that they are of a majority age and may enter into legally binding contracts.  A parent or guardian of a child may call us at the correct number belowto have any information about that child they believe has been provided to us deleted from our databases. 

When we transfer our assets.  As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, the personally identifiable information and non-personally identifiable information we have about you will be transferred to and used by this acquiring entity. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Where required by law.  We reserve the right to disclose any personally identifiable or non-personally identifiable information about you if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to. (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our website, or other customers; or (d) in an emergency to protect the health and safety of our site’s customers or the general public.

Online tracking and behavioral advertising.  At oneida.com (but not at foodservice.oneida.com), we contract with a third-party advertising partner to serve ads on our behalf across the internet and sometimes on this site. They will collect and use information about your visits to and interactions with our site through the use of tracking technologies such as cookies.  The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services.  They will use this information to personalize advertisements for goods and services. How we use email.

Communication.  When you opt-in to receive emails from Oneida, we will use email as a method of communication with you to provide you with updates on this Privacy Policy or our Terms of Service, to process your payments, alert you of messages, and send you payment receipts. announce special events and promotions, product-related announcements, and contest winners. 

Checkout.  Although our checkout procedure requires you to provide an email address in order to process your order, you may opt out of receiving future emails from Oneida by un-marking the opt-in box located below the email address section during checkout. You may also unsubscribe from future emails by following the instructions found at the end of the email message. We are not responsible for pricing, typographical, or other errors. 

Closing your account

If at any time you choose to discontinue your relationship with Oneida, you may deactivate your account by contacting us at the correct number below.  Any data concerning your past transactions or account activity will no longer be available by use of this website and will be deleted from our records. Thereafter, the data you have provided in connection with any transactions you complete through use of our Services are securely destroyed. 

Updating or Reviewing Your Information

To update your customer information (name, address, telephone number, bank or card information, and email address), please contact us at the address below or call us at the correct number below. A limited amount of transaction history may also be available to you at your request. To protect your privacy and to comply with legal regulations, we will need to verify your identity before you update or review your information.

Your California Privacy Rights.

We comply with California Civil Code Section 1798.83 by not sharing your personal information with third parties for their direct marketing purposes unless you have been given the choice to consent or withhold consent, in which case we will honor your choice. Under California law, you have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes by contacting us at the correct number below, or by writing us at the address below. You are limited to one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. We disclose our tracking and “do not track” practices and California minor’s rights to certain removal of their posts above. 

Transfers

Oneida is a global company and offers its products outside of the United States as well as to U.S. consumers.  The United States, European Economic Area (“EEA”) Member States, and other countries all have different laws.  When your information is moved from your home country to another country, the laws and rules that protect your personal information in the country to which your information is transferred may be different from those in the country in which you live.  For example, the circumstances in which law enforcement can access personal information may vary from country to country.  In particular, if your information is in the US, it may be accessed by government authorities in accordance with US law.

To the extent that Oneida is deemed to transfer personal information outside of the EEA, we rely separately, alternative, and independently on the following legal frameworks to transfer your information.

Model Clauses

The European Commission has adopted standard contractual clauses (also known as Model Clauses), which provide safeguards for personal information that is transferred outside of Europe.  We often use these Model Clauses with our business partners when transferring personal information outside of Europe.  You can request a copy of our Model Clauses by emailing dataprivacyoffice@theoneidagroup.com.

Necessary for the performance of the contract between Oneida and its members

To use our site and to place orders for products, you need to agree to our Terms of Service, which set out the contract between Oneida and its members.  As we operate in countries worldwide (including the US) and use technical infrastructure in the US to deliver the Services to you, in accordance with the contract between us, we need to transfer your personal information to the US and to other jurisdictions as necessary to provide the Services. 

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. Any payment transactions or order information transmitted will be encrypted in transit using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to your account, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the site. What personal data do we hold?

We may receive personal data about you from our vendors or affiliates, such as your personal contact information (name, home or business address, email address, phone number, and country of residence), in the context of providing to servicing and support to our customers.

Where did we get your personal data?

We collect your personal data when you ask us to contact you, or when you place an order for our products and services.  Your failure to provide this information means we cannot fulfill your request. We may also collect your contact information when you provide it by using our Website, as well as your IP address and other information about your activity on our Website, such as what pages you visit. We may also receive personal data when we are working on the resolution to our customers’ problems.

Where the basis for processing is “fulfillment of a contract”, you need to know that we will not be able to process your order or request for a quote if you do not provide us with your personal data that we request.

What we do with your personal data?

We use your details so that we can communicate with you by email or phone and inform you of our services, the status of your order, or questions about payment of your invoice. We may also collect your IP address and details concerning your activity while on our Website in order to understand your interests and preferences.

The personal data we hold is stored and processed securely in line with the information security measures and guidance standard in our industry.  We have implemented appropriate technical and organizational measures designed to prevent the unauthorized disclosure of your personal data, taking into account the level of risk associated with the processing of your personal data.

If we receive your personal data in the context of providing problem solving services to our customers, we will securely accept that data, segregate it from other customer data, and limit access to the data. We will delete the data once the issue is resolved.

We do not pass your information to anyone else apart from our business services partners as necessary to provide you with the products and services you have requested. We do not use any automated systems relating to your personal data. 

How long do we keep your personal data?

We will retain your personal data for the period necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required or permitted by law, or we have obtained your consent.

What are my personal data rights?

You have the following rights concerning your personal data that we hold and process that you can exercise at any time.

 

  • Right of access – you have the right to request a copy of the information that we hold about you.
  • Right of rectification – you have a right to correct personal data that we hold about you that is inaccurate or incomplete.
  • Right to be forgotten – in certain circumstances you can ask for the personal data we hold about you to be erased from our records.
  • Right to restriction of processing – where certain conditions apply to have a right to restrict the processing.
  • Right of portability – you have the right to have the personal data we hold about you transferred to another organization.
    • Right to object – you have the right to object to certain types of processing such as direct marketing.
    • Right to judicial review. in the event that we refuse your request under rights of access, we will provide you with a reason as to why. You have the right to complain as outlined in the process below.
